LOS ANGELES FEDERAL COURT ENTERS DEFAULT AGAINST ROBERT N. ROOKS, TWO CORPORATIONS AND FOUR CO-DEFENDANTS IN CONNECTION WITH ALLIED ARTISTS TRADEMARK INFRINGEMENT
Los Angeles, CA - On January 13, 2009, the United States District Court for the Central District of California entered a default against Robert N. Rooks, Darron Carr, Carlton Jinkens, Jammie Padilla, Mark Nolte and two corporations formed by Rooks in California and Nevada.
Rooks and his co-defendants were named by Allied Artists International, Inc., in a $50 million dollar trademark infringement action filed with the court on December 9, 2008. The complaint alleges that Rooks and his co-defendants named both corporations "Allied Artists Pictures Corporation" as part of a scheme to impersonate the real "Allied Artists" in violation of federal trademark laws. According to the complaint, Rooks and his co-defendants used the existence of the two infringing corporations, along with a counterfeit website to lure unsuspecting investors to his fledgling International Synergy Holding Company, Limited, believing they were investing in the real Allied Artists. International Synergy Holding Company, Limited is publicly traded on the Frankfurt Exchange as IBS.F. Rooks has previously been enjoined by the same Los Angeles federal court from future violations of Section 10(b) of the Securities Exchange Act of 1934 and Rule 10b-5 thereunder, resulting from an action previously brought against Rooks by the United States Securities and Exchange Commission.
The defendants had until January 10, 2009 to respond, but failed to do so, resulting in the court's January 13, 2009 entry of default.
