Robert N. Rooks and four others facing $50 Million claim by Allied Artists International, Inc. for Trademark Infringement, False Description and Injury to Business Reputation in connection with the impersonation of Allied Artists and launching a counterfeit website.

 

 

Allied Artists International, Inc., the sole and exclusive owner and holder of the "Allied Artists" trade name and trademarks, has today named Robert N. Rooks, Darron Carr, Carlton Jinkins, Jammie Padilla, Mark Nolte and several corporations in connection with a scheme to impersonate Allied Artists by unscrupulously forming "Allied Artists Pictures Corporation." Under the direction of Rooks, the group then used the unlawfully formed "Allied Artists Pictures Corporation" to lure unsuspecting investors into purchasing virtually worthless stock.

Rooks has an enduring and spurious past, having been indicted in September of 2000 by the United States Attorney for the District of Nevada, on multiple counts of conspiracy, wire fraud, aiding and abetting and money laundering, and subsequently being permanently enjoined from future securities violations by the United States District Court for the Central District of California. In the later action, brought by the United States Securities and Exchange Commission, a Los Angeles federal court found that Rooks disseminated false and misleading information in 1996 that caused a publicly-traded company's stock price to skyrocket from $.13 to $4, or more than 3,000%.

In its complaint against Rooks and his co-defendants, Allied Artists International, Inc. charges that the quintet unlawfully formed two corporations, both named "Allied Artists Pictures Corporation;" one in California and the other in Nevada, for the express purpose of impersonating the real "Allied Artists," in violation of federal law. Additionally, the defendants are accused of unlawfully launching a website located at www.alliedartistspicturescorp.com, also in violation of the real Allied Artists' trade name and trademarks. The real Allied Artists' website can be found at www.alliedartists.com.


Having been previously found guilty of securities fraud by the United States District Court for the Central District of California, Rooks is permanently banned from involvement with publicly traded companies. However, the counterfeit website established by Mr. Rooks and his co-defendants, directs the public to a Yahoo! Finance page claiming that International Synergy Holding Company, trading on the Frankfurt Exchange, has acquired "Allied Artists Pictures Corporation." In reality, "Allied Artists Pictures Corporation" is nothing more than two vacuous corporations Rooks and his co-defendants created in violation of the real Allied's trademarks, for the purpose of disseminating false information designed to artificially inflate International Synergy's stock price.

Allied Artists International, Inc.'s President, Robert Fitzpatrick, remarked that "Allied will not tolerate any violations of its long recognized federal trademarks and will aggressively pursue those attempting to tarnish them." Brenton L. Horner, lead trial counsel for Allied Artists International, Inc., states that "these defendants' actions are textbook trademark infringement and violate a multitude of other federal and state laws. I expect the federal court will act swiftly." Fitzpatrick adds that throughout the years "a number of people have tried to enrich themselves through various schemes involving misuse of the Allied name," and warned the public to "be careful of any website that claims to be associated with Allied Artists, unless that website is properly linked to and from the www.alliedartists.com site."

Allied Artists does not charge musicians, screenwriters or producers to submit material for consideration, and does not solicit investments through its website. The only legitimate website that accepts submissions on behalf of Allied Artists is the www.alliedartists.com site.
